Greybull resident Phillip “Charlie” Barham, 64, was released from jail Friday after at least 12 felony charges filed against him in October were dismissed by Big Horn County and Prosecuting Attorney Georgia Antley Hunt. Barham was held on a $750,000 bond since his arrest more than five months ago.
A preliminary hearing was held in October in the Fifth Judicial District Circuit Court where it was determined that enough evidence existed to move the case forward for trial in District Court. Barham hired Sheridan defense attorney James Castlberg.
Hunt said, “The charges against Mr. Barham had to be dismissed, as the victim became unwilling to proceed further. Sexual assault cases are difficult not only because of the sensitive subject matter but also because it's generally the victim's statement versus that of the defendant. Not very often is there corroborating evidence that can be presented in the victim's absence.”
Eleven of the charges stemmed from allegations he kidnapped and raped a woman on July 29, 2009, at his South Fifth Street residence and vacant house, also on South Fifth Street.
A cell phone was used to videotape a portion of the events, according to authorities.
Barham was also accused of aggravated battery stemming from an incident in the summer of 2008 when he allegedly threatened another woman with a drawn gun.
